Evidence gathered as a result of tracking someone’s whereabouts without their consent will not hold up in court…unless you’re in Minnesota and you attach a GPS tracking device to a vehicle of which you a part owner.
A Minnesota man used a GPS tracking device to track his spouse’s car after she moved out as a result of a domestic violence charge that she reported against him. When she tried to press charges against him for tracking her without her consent, the court found that because he is co-owner of this vehicle that was purchased with marital funds at the time they were married, he is within the legal limits and has rights to the vehicle.
Further, if he were to drive the vehicle without her consent, he would not be susceptible to charges of auto theft. This vehicle was registered in the wife’s name only, but the defendant was able to produce evidence showing that the vehicle was purchased with marital funds, and was thus, presumptively, joint marital property.
The defendant in this case used his knowledge of his ex-wife’s whereabouts to not only track her, but show up unannounced at a lakeside cabin and physically attack one of her acquaintances.
